Required Car Insurance in Utah

Utah law requires you to maintain various types of insurance. The following minimum amounts are required of all auto insurance policies sold in Utah:

  • $25,000 in bodily injury liability coverage per person
  • $65,000 in bodily injury liability coverage per accident
  • $15,000 in property damage liability
  • $3,000 in personal injury protection (PIP) coverage

Liability coverage pays for the damages you cause someone else if you are found at fault for the accident, while PIP covers your own medical expenses, regardless of fault. Additionally, uninsured motorist coverage is required unless the insured affirmatively waives it.

Utah’s No-Fault Insurance System

Utah is one of about a dozen states that use some type of no-fault auto insurance system. Under this system, each injured party turns to their PIP coverage to pay for medical treatment and other financial losses, regardless of fault. Under a no-fault system, you are unable to receive compensation for pain and suffering or other non-economic damages unless you meet certain exceptions.

To file a claim against the at-fault driver, your injuries must meet a certain threshold. This threshold requires you to have suffered more than $3,000 in medical expenses resulting from the collision or suffered any of the following types of injuries:

If your injuries meet any of the definitions above, your damages are not limited. You can seek compensation for the full extent of your medical expenses, lost income, pain and suffering, loss of enjoyment of life, and other damages.

If your damages exceed the amount of insurance coverage the at-fault party has, you may be able to file a personal injury lawsuit against the party responsible for your injuries. If a loved one was involved in a fatal accident, an experienced South Jordan wrongful death lawyer can discuss your various options for pursuing compensation.
